Notice was given that the City Council may be in attendance at the Planning and Zoning Commission meeting held on May 19, 2022.


1. Call to Order and Quorum

  • Chairman Scott Kelley called the meeting to order at 6:00 p.m.
  • Deputy City Secretary Samantha Harris confirmed a quorum.

2. Public Comment

  • No members of the public addressed the Commission.

Items considered:

  • Approval of Planning and Zoning Commission meeting minutes from April 21, 2022.
  • Approval of the final plat for Woodcreek Planned Development, Phase BA (Case #FP-22-001).
  • Approval of the final plat for Edgewater Planned Development, Phase 3 (Case #FP-22-002).

Action Taken:

  • Motion to approve the consent agenda as presented was made by Commissioner Karen Kiser.
  • Motion was seconded by Commissioner Kerry Wiemokly.
  • Vote: Unanimous approval.

4. Action Items / Public Hearings

a. Special Use Permit — Off-Premise Liquor Sales

Case #: SUP-22-002
Applicant: Hossain Makvandi
Location: 2975 SH 66 (Homeboys Exxon)

  • Staff summary presented by Ryan Wells, Director of Planning and Development Services.
  • No applicant presentation was provided.
  • Public hearing opened and closed at 6:09 p.m.
  • Discussion occurred among Commission members.

Action Taken:

  • Motion to approve the Special Use Permit with staff recommendations was made by Chairman Kerry Wiemokly.
  • Motion was seconded by Commissioner Karen Kiser.
  • Vote: Unanimous approval.

b. Zoning Change and Concept Plan — Fate Village Commercial Area

Case #: ZR-22-001 and CP-22-001
Location: Northwest corner of Memorial Parkway and Williamsburg Parkway

  • Staff presentation provided by Robbie Highfield, Associate Planner.
  • Applicant presentation provided by Shane Thompson with LJA Engineering.
  • Public hearing opened and closed at 6:41 p.m.
  • Public notice included 13 notices sent and two responses received.
  • Commission discussion addressed zoning, traffic analysis, residential density, and review thresholds.

Action Taken:

  • Motion to approve Case #ZR-22-001 as presented and Case #CP-22-001 with staff conditions, including an amendment regarding residential density, was made by Chairman Scott Kelley.
  • Motion was seconded by Commissioner Chelsea Priest.
  • Vote: Unanimous approval.

City Secretary’s Note:

  • Chairman Kelley stepped out at 6:59 p.m. and returned at 7:01 p.m.

c. Fate Unified Development Ordinance Update

  • Presentation on Module 1 was provided by Felix Landry with URBEX Solutions.
  • Presentation on Module 2 was provided by Mark White with White & Smith.
  • Commission discussion addressed zoning standards, residential design, permitting processes, and signage regulations.

City Secretary’s Notes:

  • Temporary departures and returns of Commissioners and staff were recorded during this item.

5. Director of Planning and Development Services Report

  • Ryan Wells stated that the Unified Development Ordinance update would continue at the June meeting.

6. Adjournment

  • Motion to adjourn was made by Commissioner Kerry Wiemokly.
  • Motion was seconded by Commissioner Steve Dann.
  • Vote: Unanimous approval.
  • Chairman Scott Kelley declared the meeting adjourned at 9:02 p.m.

  • Approved by the Planning and Zoning Commission in July 2022.
